This is in response to your May 09, 1996, letter requesting information under the Freedom of Information Act (FOIA)(5 U.S.C. 522(b), as ammended), information concerning plague vaccine lot no 10H03A. Your request was forwarded to us by the Defense Personnel Support Cetnter, Philadelphia, PA 19145-5099.
Your FOIA request was assigned Case Number DDRW-96114. Thank you for the added information on the vaccine. However, our serach did not reveal any records. Therefore, a "No Records" response is issued for your request. Pursuant to Defense Logistics Agency Regulation (DLAR) 5400.14, there is no obligation to create or compile a record to satsify a FOIA request.
For the "No Records" response the following appeal rights apply.
You have a right to appeal this denial. Your appeal must be in writing, must be made within 60 days from the date of this letter, and should include your reasons for reconsideration. Forward your appeal to the FOIA Manager, Defense Logistics Agency, Defense Distribution Region West, PO Box 960001, Stockton, CA 95296-0211. Also please include a copy of this letter with your appeal and refer to the case number as DDRW-96114. Enclosed is a copy of this letter.
Since you are an individual requester, the fee categories that apply to your request are all computer and manual search (less the first two hours), reporduction (less the first 100 pages) and special services.
The fees for this request have been waived. However, the fees as previously stated in the acknowledgement letter of November 22, 1996, may apply to future requests.
